Waiver of Liability
By booking, participating in, or using any services provided by BALKAN ADVENTURE D.O.O. (hereinafter referred to as the “Company”), I acknowledge that I have read, understood, and agreed to this Waiver of Liability.

1. Release of Liability

I, on behalf of myself, my heirs, personal representatives, or assigns, hereby waive, release, and discharge BALKAN ADVENTURE D.O.O., its officers, employees, agents, contractors, affiliates, and guides (collectively referred to as “Staff”) from any and all claims, demands, actions, or causes of action arising out of or related to any injury, illness, accident, death, property loss, or other damages sustained before, during, or after participating in any tour, activity, or event (hereinafter referred to as the “Activity”), whether caused by negligence or otherwise.

2. Assumption of Risks

I voluntarily and knowingly assume all risks associated with participating in an Activity, including but not limited to:

• Travel Risks – Risks related to transportation, including walking, cycling, driving, or public transit.
• Activity Risks – Injuries or accidents arising from adventure tourism, physical exertion, terrain conditions, weather, or wildlife.
• Food & Beverage Risks – Risks from consuming food, beverages, or alcohol during the Activity.
• Third-Party Risks – Risks associated with locations owned or managed by third parties, including restaurants, shops, roads, and public areas.

I acknowledge that these risks may result in serious injury, illness, or death and that the Company cannot guarantee my safety.

3. Fitness & Medical Disclaimer

I confirm that I am physically, mentally, and emotionally fit to participate in the Activity. Specifically:

• I have no medical condition, disability, or impairment that could be affected by participation.
• I am not under the influence of alcohol, drugs, medications, or substances that may impair my judgment.
• If I have any concerns about my health, I have consulted a medical professional before participation.

I understand that the Company is not responsible for providing medical assistance in case of injury or illness.

4. Indemnification & Hold Harmless

I agree to indemnify and hold harmless the Company and its Staff from any claims, liabilities, costs, or legal expenses arising from my participation in an Activity. If the Company incurs costs due to my actions or claims against them, I agree to reimburse these costs in full.

5. Force Majeure

I acknowledge that the Company is not liable for cancellations, delays, or changes due to events beyond its control, including but not limited to natural disasters, extreme weather, pandemics, government restrictions, civil unrest, or transportation disruptions. No refunds will be provided in such cases.

6. Photo & Video Release

I grant the Company permission to use photographs, videos, or recordings taken during an Activity for promotional, marketing, or advertising purposes, without compensation or further approval. If I do not wish to be recorded, I must notify the Company in writing before the Activity.

7. Governing Law & Jurisdiction

This agreement is governed by the laws of Montenegro. Any disputes arising from this waiver shall be resolved exclusively in the courts of Montenegro.

8. Severability

If any part of this waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.

9. Acknowledgment & Acceptance

I have read and fully understood this Waiver of Liability. By booking, purchasing, or reserving an Activity, I agree to all terms herein. I understand that I am waiving my right to legal action against the Company and its Staff.

By using any services of BALKAN ADVENTURE D.O.O., I acknowledge that I accept this Waiver of Liability without requiring a physical signature.
